Agreement to Terms

By accessing or using the services provided by CareWay Poinciana Landscapers, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, customers, and others who access or use our landscaping services.

Services Description

CareWay Poinciana Landscapers provides professional landscaping services including but not limited to lawn care, landscape design and installation, hardscaping, irrigation systems, tree trimming, sod installation, outdoor lighting, drainage solutions, seasonal cleanups, commercial landscaping, mulching, and artificial turf installation. All services are subject to availability and scheduling.

Quotes and Pricing

All quotes are valid for 30 days from the date of issue unless otherwise specified. Quotes are estimates based on site conditions at the time of inspection. Final pricing may change if unforeseen conditions arise during service delivery. We will inform you of any changes before proceeding with additional work.

Payment is due upon completion of services unless other arrangements have been made in writing. We accept cash, check, and major credit cards. For ongoing maintenance contracts, payment terms will be specified in your service agreement.

Scheduling and Cancellations

We will make every effort to arrive during scheduled service windows. Weather conditions, equipment issues, or other unforeseen circumstances may require rescheduling. We will notify you as soon as possible if we need to change your appointment.

If you need to cancel or reschedule, please provide at least 24 hours notice. Cancellations with less than 24 hours notice may be subject to a cancellation fee equal to 50 percent of the scheduled service cost.

Property Access and Preparation

You are responsible for ensuring clear access to all areas where services will be performed. This includes unlocking gates, moving vehicles, and securing pets. You must also mark or identify any underground utilities, sprinkler lines, or other buried infrastructure before we begin work.

If we cannot access your property or complete services due to locked gates, aggressive animals, or other obstacles, you may be charged a trip fee. We are not responsible for damage to unmarked underground utilities or infrastructure.

Warranty and Guarantees

We guarantee our workmanship for 30 days on most services. Plant materials are guaranteed for 30 days from installation, provided they receive adequate water and care according to our instructions. This guarantee does not cover damage from extreme weather, pests, disease, or neglect.

Hardscaping and installation work is guaranteed for one year against defects in workmanship. This does not include damage caused by ground settling, tree roots, freeze-thaw cycles, or other natural events beyond our control.

Limitation of Liability

We carry general liability insurance and take every precaution to protect your property. However, we cannot be held liable for pre-existing damage, damage caused by natural events during or after service, or damage to unmarked utilities and infrastructure.

Our total liability for any claim will not exceed the amount you paid for the specific service in question. We are not liable for indirect, incidental, or consequential damages.

Service Standards and Safety

All services are performed in accordance with industry standards and local regulations. We use professional equipment and follow safety protocols to protect our team and your property. We reserve the right to refuse service if conditions are unsafe or if weather makes work impossible or inadvisable.

Chemical Applications

When pesticides, herbicides, or fertilizers are applied, we follow all EPA and state guidelines. You will be notified before chemical applications, and appropriate signage will be posted as required by law. Keep children and pets away from treated areas until they are safe for re-entry, typically 24 to 48 hours or as specified on product labels.

Termination of Services

Either party may terminate ongoing maintenance agreements with 14 days written notice. You are responsible for payment of all services performed up to the termination date. We reserve the right to terminate service immediately if payment is not received, if access to your property is denied, or if we encounter threatening or abusive behavior.

Dispute Resolution

If you have a concern about our services, please contact us immediately. We will work with you to resolve the issue fairly and promptly. Any disputes that cannot be resolved through good faith discussion will be handled through binding arbitration in Osceola County, Florida.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
